  • I am a Spanish haulier with an EU licence and I want to formalise a contract to carry out the international haulage of oranges from Almería to London and, subsequently, a cabotage operation between London and Birmingham. What do I have to take into account if I carry out the aforementioned haulage in this no-deal scenario after 29 March 2019?

    Currently, there is already an agreed EU Regulation text regarding the international road transport of freight and passengers to and from the United Kingdom, which is pending the formal approval of the Parliament and the Council.

    The aforementioned Regulation aims to establish temporary measures (until 31 December 2019) to avoid the interruption of international road transport.

    As for the cabotage, the agreed text foresees temporary measures – that will be gradually eliminated – on this right to allow UK hauliers to carry out a maximum of two additional loading and unloading operations during the 7 days following the international haulage of freight in European Union territory. This regulation would be applied within a term of 4 months from the application date of the Regulation, and would be reduced to one single operation in the following 3 months. After this term of 7 months from the application date of the agreed Regulation, no operation may be carried out following the previous international transport.

    These rights, which are granted by virtue of these measures, will be dependent on the United Kingdom granting equivalent rights to the hauliers of the 27 Member States and on the respect of conditions that guarantee fair competition.

    The agreed Regulation will be applicable from the day following the withdrawal of the United Kingdom from the European Union, unless a withdrawal agreement formalised with the United Kingdom has come into force before this date, and it will no longer apply as of 31 December 2019.

  • I am an English road passenger transport operator with an EU licence and I operate a regular international transport passenger service from London to Barcelona. What do I have to take into account for these transport services in this no-deal scenario after 29 March 2019?

    The agreed text of the aforementioned EU Regulation also governs the regular international transport of road passengers to and from the United Kingdom, and aims to establish temporary measures to avoid interruption to international road transport.

    The aforementioned Regulation provides recognition of the validity of authorisations issued prior to the application date of the Regulation until 31 December 2019, as well as those that remain valid if they have been renewed or modified, in accordance with the standards and procedures of articles 6 to 11 of (EC) Regulation no. 1073/2009, for providing authorised regular and special regular coach and bus services for hire or reward.

  • I am a Spanish transport operator carrying out operations to or from the United Kingdom and I have a workforce of drivers with nationalities from the European Union and drivers from the United Kingdom and third countries. When providing any of the aforementioned transport services, will they be subject to any additional restrictions in the European Union as regards the CPC (certificate of professional competence) for drivers?

    During the period of validity of the included contingency measures, the aforementioned Regulation provides that, in carrying out the permitted operations of the international transport of passengers and freight, drivers must comply with the initial and ongoing training requirements provided by Directive 2003/59/EC.
