Certificados de no accidentes para pilotos

En relación con las numerosas solicitudes que se reciben en la CIAIAC de pilotos participantes en procesos selectivos de compañías aéreas de transporte aéreo comercial que son requeridos a presentar un certificado que garantice que no se han visto involucrados en ningún accidente o incidente grave de aviación, la Secretaría de la CIAIAC puntualiza lo siguiente:

La información recopilada por las autoridades de investigación de accidentes se encuentra protegida por Anexo 13 de OACI, Reglamento (EU) Nº 996/2010 y Ley 21/2003. Por ello, según dicha legislación, esta información únicamente puede ser utilizada por dichas autoridades con la exclusiva finalidad de prevenir futuros accidentes y mejorar la seguridad operacional, quedando limitada su difusión a terceros con fines distintos a los anteriormente expuestos.

Por este motivo, los informes finales de las autoridades de investigación no contienen datos personales y la mera consulta de la información recopilada por la autoridad de investigación para cotejar si un determinado piloto se encuentra incluida en ella, para satisfacer este tipo de peticiones, supondría una utilización inapropiada de la misma.

En respuesta a las numerosas solicitudes que se reciben habitualmente en la CIAIAC y con el objetivo de no obstaculizar el normal funcionamiento de la Secretaría, todos aquellos solicitantes que lo deseen pueden descargar y presentar el siguiente comunicado oficial de la CIAIAC que hace referencia a la imposibilidad de emitir dicho certificado.

In relation with the many enquiries that CIAIAC receives from pilots taking part in selection procedures for commercial air transport airlines, where they are required to submit a certificate that guarantees that they have not been involved in any civil aviation accident or serious incident, CIAIAC wishes to state the following:

Law under ICAO Annex 13, Regulation (EU) n º 996/2010 and Law 21/2003, protects the information gathered by the Safety Investigation Authorities. Therefore, as per this legislation, this information must be exclusively used by the Safety Investigation Authorities for the only purpose to prevent future accidents and improve safety, being limited the release of that information to third parties for purposes other than using it during the technical investigation.

Considering all of the above, the final reports of the Safety Investigation Authorities do not include any personal details. The mere fact of checking the information gathered by the Safety Investigation Authority to verify if a pilot is included therein to satisfy this kind of enquiries would imply an inappropriate use.

However, considering the many requests that CIAIAC usually receives, and in order not to hamper the ordinary operation of this Secretary, all the applicants who want it may download and submit the enclosed CIAIAC official note, explaining the impossibility of issuing such certificate.
